These terms and conditions of use (hereinafter also referred to as the “ToS”) govern the relationship between the users of the www.dolomitivalcomelico.it<\/a> website (hereinafter referred to as the “Website”) and Unione Montana Comelico (hereinafter referred to as the “Company”), establishing rights and obligations in the use of the same.<\/p>

Read them carefully: by using the Site, you accept them in full and undertake to comply with them.<\/p>

These terms and conditions of use are valid only for the Site and do not extend to other domains, which may be consulted through hyperlinks, even if managed by the Company.<\/p>

The Unione Montana Comelico is the owner of the Site and has entrusted its operational management to the Val Comelico Dolomiti Tourist Consortium to promote the area of competence and respond to an information need with respect to citizens. In this sense, through the Site it is possible to obtain useful information to contact the competent bodies and book, through a link to another site, experiences or accommodation<\/strong> related to the territory. <\/p>

2.1 The use of the Site does not require the payment of any fee by the user.<\/p>

2.2 A data connection is required to use the Site, the costs of which are not borne by the Company.<\/p>

3.1 All websites that do not belong to the Company and which the user can access, including as a result of accessing a hyperlink on the Site, are independent of the Site itself. The Company has no power of control, either direct or indirect, over them and their content or use. <\/p>

3.2 The user acknowledges and accepts that no type of responsibility, not even indirect, may be attributed to the Company for content, products or other goods\/services, as well as for the use of the hyperlinks referred to above, and that the presence on the Site of a hyperlink (link) to another web address does not imply any type of assumption or acceptance of responsibility by the Company itself regarding the content or use of the linked site. The user expressly agrees, therefore, to indemnify and hold the Company harmless from any damage, loss and detrimental consequence suffered by the user. <\/p>

3.3 The regulations on the protection of personal data established on this Site do not apply with regard to third-party sites over which the Company exercises no control. The Company cannot therefore be held responsible for any violation of the legislation on the protection of personal data implemented by such third-party sites. <\/p>

Proper Use and User Obligations<\/h3>

By using the Site, you agree to these ToS and agree to comply with them at all times. You may use the Site only for the purposes authorized by these ToS and in accordance with applicable law. <\/p>

The user undertakes not to use, directly or indirectly, the Site:<\/p>

  • in violation of the rights of the Company or third parties;<\/li>
  • for marketing, promotional and\/or advertising purposes;<\/li>
  • in an unlawful, defamatory, obscene, vulgar, intimidating, offensive manner towards the Company or third parties;<\/li>
  • to transmit unlawful or unauthorized communications, such as bulk messages, spam or automated messages;<\/li>
  • to communicate false, misleading or unlawful data or information;<\/li>
  • to transmit viruses, malware or other malicious code to any device or system and\/or hack;<\/li>
  • circumvent or tamper with access and authentication;<\/li>
  • access through programs or methods other than those officially released and operated by the Company;<\/li>
  • use it in violation or overload of network capacity.<\/li><\/ul>

    User liability, indemnification and indemnification<\/h3>

    The user is required to promptly notify the Company if he\/she becomes aware of unauthorized use of or access to the Site or of any breach, malfunction or security incident. If such events involve breaches and intrusions into personal data, the user will promptly inform the Company within 24 hours of the occurrence of the event. The Company cannot be held responsible for any damage or inefficiency resulting from unauthorized use and access made through the use of the credentials in the user’s possession. <\/p>

The Company may autonomously take all necessary measures, including the suspension or interruption of the Site or its use by a user, if the user makes illegal or otherwise prohibited use of it, or commits a substantial or repeated violation of these ToS. <\/p>

      6.2 The Company may \u2013 in accordance with the applicable primary and secondary legislation \u2013 detect access to the Website and, if it finds a breach of security and data protection procedures, temporarily suspend users and deactivate them, without prejudice to any other remedy, including jurisdictional remedy, permitted by law.<\/p>

      7. Exclusions and limitation of liability<\/h2>

      7.1 Users are solely responsible for the data entered on the Site. Before providing third-party data, the user is invited to verify that he or she has received all necessary authorization to use such data with specific reference to their dissemination on the Site. <\/p>

      7.2 The Company is solely responsible for the functionality of the Site and, consequently, no damage or loss may be attributed to it that is not a direct consequence of the violation of these ToS by the same.<\/p>

      8.2 If you do not agree to the changes made to these ToS, as your sole remedy, you may, at any time, for any reason, without notice and without any cost or charge, cease using the Site.<\/p>

      9. Intellectual property<\/h2>

      9.1 The Company, in accordance with the terms of the agreement to join the Service, provides the member with a limited and non-exclusive license to use the Site.<\/p>

      9.2 Unione Montana Comelico is the exclusive owner of the contents of the Site, including, but not limited to, text, page layout, design and know-how. The manager, the Val Comelico Dolomiti Tourist Consortium, is the owner of the rights to the images used on the Site. <\/p>

      9.3 No content of the Site may be considered or interpreted as licensed and\/or as the subject of any other right of use by users and\/or third parties.<\/p>

      10. Applicable law and jurisdiction<\/h2>

      10.1 These ToS are governed by Italian law.<\/p>

      10.2 Any dispute that may arise between the user and the Company in relation to these ToS and\/or the Site will be subject to the exclusive jurisdiction of the court of Belluno or the judge of the place of residence or domicile of the user, if qualified as a consumer pursuant to Legislative Decree no. 206\/2005.<\/p>
